Biometric Disclosure and Consent

KBP Brands and its subsidiaries (the “Company”) utilizes biometric time clocks in its facilities. Time clocks provide the most efficient manner in which to track hours worked and attendance. In addition, biometric time clocks that require the use of fingerprints, thumbprints, or hand scans provide a secure and accurate way to measure your time worked at the Company. Your time clock entries, once approved by your supervisor or manager, are used to calculate payroll efficiently and accurately.

In furtherance of providing efficient and accurate payroll, the Company (and/or its third- party vendor(s)) collects and stores your biometric data, including but not limited to your fingerprint, thumbprint, or hand scan data, in connection with its biometric time clocks. The Company will store and maintain this data for the duration of your employment or until the Company ceases to use biometric time clocks, whichever occurs first. In the event of the separation of your employment and/or the Company ceases to use biometric time clocks, the Company (and/or its third-party vendor) will destroy the relevant biometric data in its possession no later than one business day after the separation of your employment and/or the Company ceasing to use biometric time clocks, whichever occurs first.

A copy of this Policy is posted in the restaurant and is also available upon request.

I understand, agree, and consent to:

1. The collection, storage, and maintenance of my biometric data, including but not limited to my fingerprint, thumbprint, or hand scan data, for purposes of processing the Company’s payroll;

2. The collection, storage, and maintenance of my biometric data, including but not limited to my fingerprint, thumbprint, or hand scan data, until the separation of my employment with the Company and/or the period of time during which the Company uses biometric time clocks, whichever occurs first; and

3. The disclosure of my biometric data, including but not limited to my fingerprint, thumbprint, or hand scan data, to the Company’s third-party vendor(s), if any, for processing the Company’s payroll.

THIS POLICY IS NOT A CONTRACT OF EMPLOYMENT, AND IT MAY BE MODIFIED AT THE DISCRETION OF THE COMPANY AT ANY TIME, WITH OR WITHOUT NOTICE TO YOU IN ACCORDANCE WITH ITS TERMS. NOTHING CONTAINED IN THIS POLICY ALTERS YOUR “AT-WILL” EMPLOYMENT RELATIONSHIP WITH THE COMPANY.
