MOTUS – Personal Transportation

Motus Users
In addition to the Personal Transportation Policy, Motus users must also adhere to the following processes and controls to ensure valid driver’s licenses, liability insurance, and remittance of business mileage to substantiate automobile allowances. These processes and controls are in place to protect the organization and mitigate risk.

The Motor Vehicle Record Inquiry (Initial and Ongoing)
As a condition of employment, all externally hired and internally promoted Motus users are required to consent to, and successfully complete, a Motor Vehicle check. Post hire or promotion, the company will also periodically monitor this population for a valid driver’s license. A Motor Vehicle check is in the same category as a background or credit check; therefore, the regulations of the Fair Credit Reporting Act apply. Your online consent, provided to our vendors, is requested, and must be obtained as a condition of employment.

If an applicant does not consent to the Motor Vehicle check, and/or the outcome of the inquiry produces the result that he/she does not have a valid driver’s license, the applicant will not be hired after being afforded all rights associated with the pre and adverse action period. Applicants unable to provide proof of a valid driver’s license at the conclusion of the resolution period will not be hired.

If a current employee as part of a promotion process does not consent to the Motor Vehicle check, and/or the outcome of the inquiry produces the result that he/she does not have a valid driver’s license, the employee will not be promoted to the targeted role after being afforded all rights associated with the pre and adverse action period. Internal applicants unable to provide proof of a valid driver’s license at the conclusion of the resolution period will not be promoted to the targeted role.

If a current employee as part of the periodic monitoring process does not consent to the Motor Vehicle check, and/or the outcome of the inquiry produces the result that he/she does not have a valid driver’s license, the current employee will not be allowed to drive to conduct ANY company business. Further, the employee will be suspended without pay pending a required resolution period of up to 12 days. Employees unable to provide proof of a valid driver’s license at the conclusion of the 12-day period will be separated from KBP.

Liability Insurance
In addition to holding a valid driver’s license at all times, Motus users are required to continuously carry a minimum of $100,000 in liability insurance coverage on vehicles driven for business purposes.

If the company is made aware that liability insurance in the minimum amount of $100,000 is not in place by any employee in any one of the targeted roles, the employee will be required to put in place the insurance within 5 days and may be subject to disciplinary action up to and including termination on the basis of failure to follow company policy. If the employee does not put in place or is unable to put in place the insurance the employee will not be allowed to continue in his/her current role. The company will attempt to place the employee into an open position in which driving is not an essential function prior to separating the employee from the company. Employees may also refer to KBP’s Job Descriptions for these targeted roles or refer to the initial offer letter provided for further information and clarification regarding essential functions of these roles.

Accommodations
An accommodation for Motus users not having a valid MVR, or not carrying a minimum of $100,000 of liability insurance on vehicle(s) driven for business purposes is unable to be made.

Ongoing Maintenance of Driver’s License and Liability Insurance
In the event an employee’s driver’s license becomes invalid or is not in good standing, or an employee’s insurance lapses or cancels, it is the obligation of that employee to email humanresources@kbpbrands.com to communicate this information. Further, the employee is not permitted to drive on company business under any circumstances. If the employee does not provide this notification, and drives for the company, and the company becomes aware of the invalid driver’s license or insufficient insurance, the employee will be subject to disciplinary action up to and including immediate termination.

Monthly Mileage Remittance to Motus
Employees in one of the targeted roles associated with this policy are required to complete a monthly mileage remittance to the Motus application by the 15th of each month. Employees not remitting mileage as requested WILL NOT receive the automobile allowance for that month. No exceptions will be made.
